1. Information about us
1.1 “Hammer Price”, “we”, “us” or “our” refers to Hammer Price Ltd, registered in Jersey, Channel Islands (company number 136420), with registered office at Strawberry Fields, Les Chenolles, St John, Jersey, JE3 4FB.
2. Our Terms
2.1 These terms and conditions (“Terms”) govern your use of our website www.hammerprice.co.uk (the “Site”) and our auction services.
2.2 By using our Site, you agree to be legally bound by these Terms.
2.3 Additional policies apply, including our Privacy Policy and Cookie Policy.
2.4 If you do not agree to these Terms, you must not use the Site.
2.5 We may update these Terms from time to time. You should check them each time you use our services.

3. Use of our Site
3.1 Hammer Price is an online auction platform facilitating sales between buyers and sellers of goods, including but not limited to vehicles, watches, luxury items, and other assets (“Lots”).
3.2 We act solely as an intermediary and are not a party to any contract between buyer and seller.
3.3 We do not take ownership, possession, or control of any Lots.
3.4 We are not responsible for delays caused by events outside our control.
3.5 We do not guarantee that the Site will always be available or error-free.
3.6 Any reliance on information on the Site is at your own risk.
4. Registration
4.1 You may browse the Site without registering.
4.2 To buy or sell, you must register and be over 18.
4.3 You must provide accurate personal and payment information.
4.4 By registering, you agree to:
- Provide true and accurate information
- Maintain valid payment details
- Pay all applicable fees where applicable
4.5 We may refuse or suspend accounts at our discretion.
4.6 Misuse of the Site (fraud, misrepresentation, unlawful activity) will result in suspension or termination.
5. Selling a Lot
5.1 Sellers must provide accurate and complete information when listing a Lot.
5.2 We may accept or reject listings at our discretion.
5.3 Sellers are solely responsible for:
- Accuracy of descriptions
- Condition and authenticity
- Legal ownership and right to sell
5.4 Sellers warrant that:
- They own the Lot or have authority to sell
- The Lot is free from undisclosed finance, liens, or encumbrances
5.5 All Lots must be honestly described, including defects, history, or modifications. It remains the seller’s sole responsibility to ensure the listing is accurate. Hammer Price Ltd accepts no liability for any inaccuracies, errors or omissions in any listing information supplies by the seller.
5.6 Any valuation provided by us is an opinion only.
5.7 Once a listing is approved:
- It becomes binding
- The reserve price cannot be increased
5.8 If a seller withdraws a Lot after approval (before or during auction), a fee will apply based on the reserve price or minimum buyer’s premium.
5.9 Sellers agree to exclusive listing during the auction period and must not sell elsewhere.
- If breached, a fee equivalent to the buyer’s premium (based on reserve or final bid, whichever is higher) is payable.
5.10 We may promote listings across marketing channels.
5.11 After a successful auction:
- Buyer and seller are introduced
- Transaction must complete within 7 days
5.12 If a sale fails due to seller misrepresentation, we may charge the seller the buyer’s premium.
5.13 Sellers must not bid on their own Lots.
6. Buying a Lot
6.1 Buyers must register with valid payment details.
6.2 Buyers are responsible for verifying condition, authenticity, and description of any Lot. All Lots are sold “as is”.
6.3 Inspection is encouraged where possible.
6.4 Bids are legally binding and cannot be withdrawn.
6.5 The winning bidder is legally required to complete the purchase.
6.6 Buyer’s premium fees will be automatically charged.
6.7 If payment fails:
- We may pursue recovery by any lawful means
- Including debt collection and account suspension
6.8 Buyer’s premium fees are non-refundable under any circumstances.
6.9 Buyers must not attempt to transact outside the platform.
7. Fees
7.1 Selling is free unless otherwise stated.
7.2 Buyers pay a buyer’s premium fee of 5% of the final bid (subject to minimum/maximum fees), unless otherwise stated on the listing.
7.3 Fees are binding and non-refundable.
8. Cancellation Rights
8.1 Consumers may cancel within 14 days of registering unless they have:
- Placed a bid
- Listed a Lot
8.2 Trade sellers have no cancellation rights.
9. Suspension & Termination
9.1 We may suspend or terminate accounts if:
- Terms are breached
- Payments are not made
- Misrepresentation occurs
9.2 You agree to compensate us for any losses, including unpaid fees.
9.3 We may remove listings at our discretion.
10. Cancellation of Sale
10.1 After a successful auction, buyer and seller are legally bound.
10.2 If both parties agree not to proceed, the buyer’s premium remains payable in full.
11. Disputes
11.1 Any dispute arising out of the purchase of a Lot is strictly between buyer and seller. Hammer Price Ltd acts only as an online auction platform and is not a party to the contract of sale.
11.2 We are not responsible for disputes or outcomes.
12. Logistics
12.1 Collection, delivery, and transport are the responsibility of buyer and seller.
12.2 We are not responsible for shipping or handling of any Lot.
13. Liability
13.1 We are not responsible for:
- Accuracy of listings
- Authenticity of Lots
- Condition of Lots
13.2 We exclude liability for:
- Loss of profit
- Business loss
- Indirect or consequential loss
13.3 Our total liability shall not exceed fees paid to us.
14. Special Auctions
14.1 Additional terms may apply to specific auctions or categories and will override these Terms where stated.
15. Payment Handling
15.1 We may offer a payment handling service where funds are collected from the buyer and held temporarily by us.
15.2 Where this service is used, funds will be released to the seller once confirmation has been received that the transaction has been completed, including collection or delivery of the Lot.
15.3 We act solely as a payment facilitator and are not an escrow agent, trustee, or stakeholder.
15.4 We are not responsible for verifying delivery, condition, authenticity, or compliance of any Lot.
15.5 In the event of a dispute, we may:
- delay release of funds for a reasonable period;
- rely on confirmation from either party; or
- require the buyer and seller to resolve the matter directly.
15.6 We are not obliged to investigate or adjudicate disputes and shall not be liable for any loss arising from use of this service.
15.7 Unless we have clear evidence of a dispute, we may release funds based on confirmation from either party.
Appendix 1 – Auction Details
Bidding Rules
Bidding will progress in set increments as determined by us. Standard increments will typically be £100 unless otherwise stated on the listing.
Bids must be in multiples of the stated bid increment.
We reserve the right to adjust bid increments at any time during an auction.
Maximum bids
Submitting a maximum bid enables the system to place bids on behalf of the bidder when another bid is placed against the same Lot.
If a maximum bid is placed before the reserve price is met, the system may automatically increase the bid to the reserve price where applicable.
A maximum bid will ensure the bidder remains the leading bidder until another bidder places a higher bid.
The bidder’s maximum bid will remain confidential.
If two bidders place a bid of equal value, the bid received first by the system will be the leading bid.
Auction time
All Lots will typically be open for bids for 7 days unless otherwise stated.
We reserve the right to amend the duration of any auction at our discretion.
Anti-Snipe rules
If a bid is placed within the last 2 minutes of the auction ending, the bidding time will be extended by 2 minutes.
The auction will only end when a clear 2-minute period has elapsed without a bid being placed.
Bid validity
All bids are binding and cannot be withdrawn.
We reserve the right to remove or cancel any bid where:
- it is clear that a bid has been entered in error;
- the registered payment method is invalid;
- fraudulent or suspicious activity is suspected; or
- the bidder is in breach of these Terms.
Auction integrity
Sellers must not bid on their own Lots or request or encourage others to bid on their behalf.
We reserve the right to suspend or remove any user engaging in bid manipulation or unfair practices.
Appendix 2 – Fees
Selling – it is free to sell on our website unless otherwise stated.
Buying – the buyer will be charged a buyer’s premium fee if they are the winning bidder.
Buyer’s Premium Fee – they buyer’s premium fee will be displayed on each listing and may vary depending on the lot or auction type.
Unless otherwise stated on the listing, the standard buyer’s premium is 5% of the final hammer price, subject to the minimum and maximum fees below.
The applicable buyer’s premium fee is binding and non-refundable under any circumstances.
